By accessing or using this website, placing an order, creating an account, joining a subscription, participating in a promotion, using our Korean-style AI Skin Analysis or otherwise interacting with Jelly Ko online, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Shipping Policy, Returns Policy, Subscription Terms and any other policies or notices published on this website from time to time.

If you do not agree with these Terms and Conditions, you should not use this website or place an order.

1. About Jelly Ko

This website is operated under the Jelly Ko brand. References to “Jelly Ko”, “we”, “us” or “our” in these Terms and Conditions mean the relevant Jelly Ko business entity involved in operating the website, supplying products, processing orders, providing services or managing customer communications, including our Australian and Korean operating entities where applicable.

Nothing in these Terms and Conditions is intended to limit, exclude or modify any rights you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

2. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of Queensland, Australia.

Subject to any rights you may have under applicable consumer laws, you agree that the courts of Queensland, Australia will have jurisdiction in relation to any dispute arising out of or relating to your use of this website, your purchase or use of Jelly Ko products, or these Terms and Conditions.

3. Use of the Website

You agree to use this website only for lawful purposes and in a way that does not interfere with the operation, security or availability of the website or the enjoyment of the website by other users.

Jelly Ko sells cosmetic and personal care products. Our products are not medicines and are not intended to diagnose, treat, cure, mitigate or prevent any disease, medical condition or skin disorder.

Information provided on the website, in emails, on social media, through our Korean-style AI Skin Analysis, Skin Quiz or by our customer service team is general information only. It is not medical advice and should not be relied upon as a substitute for advice from a qualified medical professional.

You are responsible for determining whether a product is suitable for you, including by reviewing the product description, ingredients list, usage directions, warnings and packaging before use.

If you are pregnant, breastfeeding, taking medication, undergoing dermatological treatment, have a known allergy, have a medical condition, have highly reactive skin, or are unsure whether a product is suitable for you, you should seek advice from a qualified healthcare professional before use.

6. Allergies, Sensitivities and Patch Testing

Skin responses vary from person to person. A product that is suitable for one person may not be suitable for another.

Before using a new product, we recommend patch testing the product on a small area of skin and waiting at least 24 hours before broader use. Discontinue use immediately if you experience irritation, redness, swelling, burning, itching, rash or any other adverse reaction.

If you experience a serious reaction, you should seek medical attention.

Ingredient lists may change from time to time due to product updates, supplier changes, regulatory requirements or reformulations. An order confirmation email does not necessarily mean that your order has been accepted. We may refuse, cancel or limit an order where we reasonably believe there has been an error, stock issue, payment issue, suspected fraud, abuse of a promotion, breach of these Terms and Conditions, or other legitimate reason.

If we cancel an order after payment has been taken, we will provide a refund to the original payment method unless otherwise agreed or required by law.

9. Prices, Currency and Payment

10. Preorders and Backorders

From time to time, we may offer products for preorder or backorder.

If a product is offered on preorder or backorder, we will aim to provide an estimated dispatch or availability timeframe. These timeframes are estimates only and may change due to manufacturing timelines, supplier delays, freight delays, customs processing, quality control checks, regulatory requirements, public holidays, courier disruptions or other circumstances beyond our reasonable control.

By placing a preorder or backorder, you acknowledge that the product is not available for immediate dispatch and that your order may be shipped at a later date.

If your order contains both in-stock and preorder items, we may ship the order together once all items are available, unless split shipping is offered or separately arranged.

If we become aware that we cannot supply a product within the stated timeframe or within a reasonable time, we will contact you and provide an appropriate solution, which may include a revised timeframe, replacement, store credit or refund, depending on the circumstances and your rights under applicable law.

We will not knowingly accept payment for a product if we know that we will not be able to supply it.

11. Shipping and Delivery

Shipping options, estimated delivery times and costs are set out at checkout or in our Shipping Policy.

Delivery timeframes are estimates only. We are not responsible for delays caused by postal services, couriers, customs authorities, weather events, strikes, incorrect addresses, failed delivery attempts or other circumstances beyond our reasonable control.

You are responsible for providing accurate shipping information. If an order is returned to us due to an incorrect, incomplete or undeliverable address, refusal of delivery, failure to collect or other issue not caused by us, we may require you to pay additional shipping costs before the order is resent.

Risk in the products passes to you upon delivery to the address provided, subject to applicable law.

12. Returns, Refunds and Consumer Guarantees

Your rights under the Australian Consumer Law and any other applicable consumer protection laws are not excluded, restricted or modified by these Terms and Conditions.

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement, refund, repair or other remedy if a product fails to meet a consumer guarantee.

Change-of-mind returns may be accepted at our discretion and subject to our Returns Policy. For hygiene and safety reasons, opened or used cosmetic and personal care products may not be eligible for change-of-mind returns unless required by law.

Nothing in our Returns Policy limits any rights you may have under applicable consumer laws.

13. Subscriptions and Automatic Renewals

If you purchase a subscription, you agree that your subscription will automatically renew at the selected frequency unless it is cancelled, paused or modified in accordance with the subscription terms displayed at checkout, in your customer portal or in our Subscription Terms.

Before purchasing a subscription, you are responsible for reviewing the subscription details, including the products included, delivery frequency, minimum commitment period, renewal schedule, discount, payment amount and cancellation process.

By starting a subscription, you authorise us and our payment processor to charge your nominated payment method for recurring subscription orders until the subscription is cancelled or otherwise ends.

If your subscription has a minimum commitment period, you agree to complete the required minimum number of orders before cancellation, unless otherwise required by law or approved by us.

You are responsible for managing your subscription through the customer portal before your next billing date. This includes updating payment details, delivery address, product selection, frequency, skips, pauses and cancellations.

Once a subscription order has been processed, we may not be able to cancel, change or refund that order unless required by law.

If a subscription payment fails, we may retry payment, contact you, suspend the subscription, cancel the subscription or take other reasonable steps to process or resolve the order.

We may change subscription pricing, discounts, products, shipping fees or terms from time to time. Where required, we will provide notice before the change applies.

14. Promotions, Discount Codes and Gift Cards

Promotions, discount codes, gifts with purchase, bundles, referral offers, rewards and other offers are subject to the terms stated at the time of the offer.

Unless expressly stated otherwise, promotions cannot be combined, applied retrospectively, redeemed for cash or used after expiry.

We reserve the right to cancel, modify, refuse or revoke a promotion, discount, reward or offer where we reasonably believe there has been error, misuse, fraud, abuse, technical issue or breach of the promotion terms.

Gift cards, store credits and promotional credits may be subject to expiry dates and additional terms, provided those terms comply with applicable law.

15. Fraud, Chargebacks and Order Verification

We reserve the right to verify, refuse, cancel, delay or limit orders where we reasonably suspect fraud, unauthorised payment, reselling, misuse of promotions, incorrect pricing, unusual activity, abusive behaviour or breach of these Terms and Conditions.

We may request additional information to verify an order, including proof of identity, billing information, address confirmation or payment verification. If verification is not provided within a reasonable time, we may cancel the order and issue a refund where appropriate.

If you initiate a chargeback or payment dispute, we reserve the right to provide relevant order, delivery, communication and account information to the payment provider, bank or dispute resolution body in order to respond to the dispute.

Nothing in this section limits any rights you may have under applicable consumer laws.

16. Korean-style AI Skin Analysis, Skin Quiz and Digital Tools

Our Korean-style AI Skin Analysis, quizzes, routine builders and other digital tools are provided for general informational and product recommendation purposes only.

They are not medical devices, diagnostic tools or substitutes for advice from a qualified healthcare professional.

Recommendations generated by these tools are based on the information you provide, automated logic, image analysis where applicable and general skincare guidance. They may not identify all skin concerns, allergies, sensitivities or medical conditions.

You are responsible for reviewing product ingredients, directions and warnings before purchasing or using any recommended product.

We do not guarantee that any recommendation will be suitable for your skin or produce a particular result.

17. User Content, Reviews and Social Media

If you submit, upload, tag, share, review, comment on or otherwise provide content to Jelly Ko, including text, photos, videos, reviews, testimonials, social media posts, feedback, ideas or other material, you confirm that you have the right to do so and that the content does not infringe the rights of any other person.

Unless otherwise agreed in writing, you grant Jelly Ko a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, repost, edit, adapt, publish, display and distribute that content for marketing, advertising, promotional, educational and business purposes, including on our website, social media, emails, advertisements and other channels.

We may identify you by your first name, social media handle, review name or other publicly available identifier associated with the content, unless you ask us not to and it is reasonable for us to comply.

We reserve the right to remove, moderate, edit or refuse user content where we consider it inappropriate, unlawful, misleading, offensive, infringing, abusive, spam, irrelevant or otherwise unsuitable.

18. Intellectual Property

21. Limitation of Liability

To the maximum extent permitted by law, Jelly Ko is not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, business interruption or other similar loss arising out of or relating to your use of the website, products, services or these Terms and Conditions.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to a product purchased from us is limited to the amount paid by you for that product.

This limitation does not apply to liability that cannot lawfully be limited or excluded, including liability under the Australian Consumer Law.

22. Indemnity

You agree to indemnify Jelly Ko, its related entities, officers, employees, contractors, agents and suppliers against any loss, liability, claim, damage, cost or expense arising from your misuse of the website, breach of these Terms and Conditions, infringement of third-party rights, unlawful conduct, fraudulent conduct or misuse of your account.

This indemnity does not apply to the extent that the loss, liability, claim, damage, cost or expense is caused by Jelly Ko’s own negligence, breach of law or breach of these Terms and Conditions.

23. Force Majeure

We will not be liable for any delay or failure to perform our obligations where the delay or failure is caused by events beyond our reasonable control.

This may include manufacturing delays, supplier issues, freight disruptions, customs delays, postal or courier delays, strikes, industrial action, natural disasters, extreme weather, pandemics, epidemics, government action, war, civil unrest, cyber incidents, technical failures, power outages or other events beyond our reasonable control.

Where such an event affects an order, we will take reasonable steps to keep you informed and provide an appropriate solution where required by law.

24. Class Action Waiver

To the fullest extent permitted by applicable law, you and Jelly Ko agree that any claim, dispute or proceeding arising out of or relating to your use of this website, purchase or use of our products, use of our services or these Terms and Conditions will be brought only in an individual capacity and not as part of any class action, consolidated action, representative action or similar proceeding.

You agree not to participate as a plaintiff, applicant, group member or class member in any purported class, collective, representative or consolidated proceeding against Jelly Ko, except to the extent that such waiver is not permitted by applicable law.

Unless otherwise agreed in writing by both parties, any dispute resolution process shall be conducted only on an individual basis and not on a class, collective, representative or consolidated basis.

If any part of this Class Action Waiver is found to be unenforceable, invalid or unlawful, that determination shall be made by a court of competent jurisdiction. Any remaining parts of this clause shall continue to apply to the maximum extent permitted by law.
